The lawsuit relates to the alleged agreement between Kaplan and BAR/BRI to limit the competition for the full-service bar review courses in the market. According to the lawsuit, Kaplan agreed not to compete against BAR/BRI in giving full-service bar review courses to aspiring attorneys in the United States. In return, BAR/BRI agreed not to compete with Kaplan in the LSAT business. This, according to the lawsuit, is a violation of the federal antitrust laws as Kaplan gave BAR/BRI the authority to monopolize and take full control of the full-service bar review business industry. The lawsuit further alleges that the agreement between BAR/BRI and Kaplan has adversely affected competition in the selling and marketing of competitive bar review courses. Both Kaplan and BAR/BRI strongly deny that they have acted illegally.
A proposed Settlement has been entered into by both parties to avoid trial. The Defendants have agreed to pay a Settlement amount of $5, 285, 000 to Class Members and to give each Class Member a discount on the overall price of full-bar review courses.
